/var/empty may be created by buildroot but it's removed by S00dev the first time it boots. The fix is to add a symlink to /var/volatile/empty from /var/empty in S00dev, then mkdir /var/volatile/empty.

Verified. This fix should remove the error message that was displayed on boot (prior to adding the splash screen).

Closing issue.
